TRADE GRANITE AND KITCHENS’ TERMS AND CONDITIONS

DEFINITIONS

In these conditions the following terms shall have the following meanings. “Company” means Trade Granite and

Kitchens.

“Customer” means the customer of Trade Granite and Kitchens.

“Contract” means any contract for materials supplied and work done by the Company to and for the Customer.

“Goods” means any goods forming the subject of this contract including any materials incorporated in them.

“Price” means the price as detailed as agreed at point of order.

EXISTENCE OF CONTRACT

2.1 No contract shall come into existence until the Customer’s order is accepted by the Company either verbally or in

writing and a deposit is paid. No variation or amendment of this document shall be valid unless committed in writing

and signed by or on behalf of both parties.

PRICES

3.1 The price for the materials supplied and work done includes Vat.

3.2 The Company shall have the right to adjust its prices for any increase in the costs of any kind arising for any

reason after the date of the Contract.

3.3 Price changes shall take effect on the date of service on the customer of notice of the change.

ORDERS

4.1 On receipt of an order from the Customer the Company will organise a convenient day for the template to take

place. The customer will advise at the template any special requirements they might have regarding overhangs etc. It

is the responsibility of the Customer to ensure that all their requirements are clearly noted on the template sheet

and that this accurately reflects the Customer’s requirements.

4.3 All natural and manmade products supplied will be subject to their natural markings, veining, variations in colour,

cracks and vents. These are supplied cramped, stopped or reinforced where necessary and no claim on this account

can be made.

4.4 Where samples have been submitted, exact resemblances of the product supplied to the sample cannot be

guaranteed.

4.5 Any descriptions of the materials offered are for information purposes only and do not imply suitability for the

purpose required by the Customer.

4.6 All materials thickness shall be 30 mm for work tops and 20 mm for up stands. A tolerance of +/- 2 mm on the

thickness of the work top and 3 mm on cut outs if polished and 2 mm if unpolished must be expected and is

acceptable.

PAYMENT TERMS

5.1 The Customer shall pay to the Company a deposit of 50% of the agreed price at the time of placing their

confirmed order.

5.2 The balance of the contract price shall be paid by the Customer immediately following the completion of the

fitting of their work surfaces.

5.3 A 15% charge will be applied to all overdue accounts after 7 days from the date of completion of installation.

5.4 All goods remain the property of Trade Granite and Kitchens until full and final payment has been made.

RISK DELIVERY AND PERFORMANCE

6.1 Delivery of the goods shall be made by the Company to the Customer’s home address unless agreement is

reached between the parties to the contrary.

6.2 Risk in the work surfaces passes when they are delivered in accordance with 6.1 above.

6.3 Any dates quoted by the Company for delivery of the work surfaces are approximate only and shall not form part

of the Contract and the Customer acknowledges that in the performance expected of the Company no regard has

been paid to any quoted delivery date.

6.4 The Company shall not be liable for any loss whatsoever sustained by the Customer as a result of any delay in the

delivery of the work surfaces.

INSTALLATION

In order to ensure a problem free installation please note the following points:-

7.1 If any over mounted sink or tap has been re connected following templating, they must be disconnected again

the day prior to installation taking place.

7.2 Any tiling in areas around work tops must take place after the installation of the work tops.

7.3 In the event of any plasterwork etc. being disturbed during fitting, all making good and subsequent costs are the

responsibility of the customer.

7.4 Please be aware that we do not have the tools or the skills to undertake gas,electrical,plastering or plumbing

work whilst installing the work tops.

7.5 Where jointing of materials is necessary it will not always be possible to secure an exact match between the

joining material and the granite or composite. Please note that jointing lines are, therefore, likely to be visible,

particularly on lighter coloured materials.

7.6 Transport of the work tops by a Third Party (the customer or their agent) is at the customer’s own risk and

responsibility.

7.7 For health and safety and insurance purposes, it is important that our fitters are allowed to work on their own in

the installation/working area until they have finished their work. No third party, customer or other tradesman

should be present in the same room or area.

7.8 We would request that customers ensure that all, as far as is practicable, doors to other parts of the house are

kept closed and to remove items of value in the installation area which may be adversely affected i.e. televisions or

ornaments etc.

SIGN OFF

8.1 Once the installation has been completed, it is essential that the customer or their representative is available to

inspect the material and workmanship.

8.2 The customer will be supplied with a Satisfaction form to complete. This will be provided by the fitter at the

conclusion of the installation. The customer will receive a copy. We will retain the original.

8.3 Once the form has been signed and the customer is satisfied with the workmanship and the material the balance

of the agreed contract price will be collected by Trade Granite and Kitchens. This will normally be 50% of the agreed

contract price but may vary from time to time.

8.4 It will be appreciated that once our fitters have left the premises it is impossible for us to verify any subsequent

claim for damage to the material or its surrounds.

8.5 This being the case, if nobody is available to sign off the work nor to complete the Satisfaction form, the

customer must accept that Trade Granite and Kitchens are no longer liable.

TITLE

9.1 Title in the work surfaces shall not pass from the Company to the Customer until the full amount due under their

agreement shall have been paid by the Customer to the Company. For the avoidance of doubt, title in the goods

shall remain that of the Company’s until cleared funds have been received by them.

9.2 The Company may at any time before title passes and without any liability to the Customer repossess the work

surfaces and by doing so shall terminate the Customer’s right to use them.

SCOPE OF CONTRACT

Under no circumstances shall the Company have any liability of whatever kind for

10.1 Any defects resulting from wear and tear, accident or improper use by the Customer of the work surfaces.

10.2 Any variations in the specifications of the materials supplied from those requested by the Customer provided

such variations do not materially affect the characteristics of the work surfaces requested by the Customer.

10.3 Any claim by the Customer which is based upon alleged defects in the quality of the goods supplied shall be

notified in writing to the Company within3 days of the work surfaces installation. If the Customer fails to notify the

Company within the time scale set out in this clause then the Customer shall not be entitled to reject the goods nor

shall the Company have any liability for any such alleged defect.

GUARANTEE

11.1 From the date of installation, we will grant a 24 month installation guarantee.

11.2 The customer must follow the care and maintenance guidelines provided by us on our website to help maintain

the natural look of the product.
